Subs Zone Creator Agreement

The rules for running a paid Subs Zone: who sells subscriptions, how much you earn, your content and obligations, suspension, termination and changes to the agreement.

In force from 29 September 2026

Version history

Parties and subject matter

You conclude this agreement with Michał Jankowski, an entrepreneur trading as Michał Jankowski Miart, ul. Wesoła 11, 82-500 Kwidzyn, Poland, tax ID (NIP) 5811841807 (“we”, “us”). Contact: [email protected].

This agreement sets out the rules for running a paid Subs Zone in AthSpace: we sell subscriptions to your Zone, make your content available to subscribers and pay you a share of the revenue. Settlements, payouts and taxes are described in detail in the Payout and Tax Policy, which forms part of this agreement.

This agreement supplements the AthSpace Terms of Service, in particular the section “Subs Zone for creators”. Terms defined in the Terms of Service have the same meaning here, and the Terms of Service apply to matters this agreement does not cover. You run a free Zone under the Terms of Service, without this agreement.

Concluding the agreement

You conclude the agreement by accepting it in the App when you set up a paid Subs Zone, together with the Payout and Tax Policy. The agreement is concluded for an indefinite period.

A paid Zone can be run by an athlete or team with active PRO whose profile is not private. While the Zone is running, you cannot make your profile private.

You must be an adult, pass identity verification with Stripe, provide tax details and a bank account, and accept the Stripe connected account agreement. Stripe runs your payout account and verifies your identity under its own rules.

A team’s Zone is run by the team’s owner: the owner concludes the agreement, is responsible for the Zone and receives its payouts. The team’s admins and moderators act in the Zone within their roles.

Who sells subscriptions

Subscribers do not buy a subscription from you. In the App they buy it in the App Store or Google Play — in that case the store is the seller. In a browser they can pay by card through Stripe — in that case we are the seller. We give subscribers access to the Zone under the Terms of Service.

The seller handles payments, cancellations, payment complaints and refunds for subscribers. Payments for the Zone are accepted only by the stores and Stripe, and you are not responsible towards subscribers for handling them.

The stores and Stripe apply their own rules to payments and content. If a store or Stripe requires sales to be changed or stopped, we must comply.

Price

You choose the monthly subscription price from the list of prices available in the App. The price applies in all sales channels; the stores and Stripe show it in local currencies or in euros and US dollars, so the amount a subscriber pays may differ slightly between channels.

Every price change needs our approval. Existing store subscribers keep their current price.

We may change the list of available prices, but this does not change your Zone’s price.

Your remuneration

Your remuneration is the revenue from your Zone subscribers’ payments. From each payment we first deduct VAT, then the store or payment provider fee (in the stores 15% to 30%, depending on the store and how long the subscription has lasted), and from the remaining amount the AthSpace fee of 15%, unless we agree a different one with you. The rest is your revenue.

Example: a payment of €12.30 leaves €10 after deducting 23% VAT. After a 15% store fee €8.50 remains, and after the AthSpace fee (€1.28) your revenue is €7.22.

We take into account the store or payment provider fee at the rate the store or provider applied to the given payment. The AthSpace fee covers making the Zone available, handling sales, settlements and payouts.

Refunds and chargebacks reduce the revenue of the period in which they occur. We do not guarantee any number of subscribers or level of revenue.

Zone content and licence

The content you publish in your Zone remains yours — we do not acquire copyright in it. You are responsible for it and confirm that you hold the rights to it, including to the music, photos and image of the people you show.

The licence you grant us in the Terms of Service (section “Your content”) covers making your Zone content available to its subscribers, including selling access to it in the stores and through Stripe.

For Zone content, the licence continues after the Zone is closed, the agreement ends or your account is deleted — until the end of subscribers’ paid periods, and after account deletion for no more than 30 days.

Your obligations

You provide true information about yourself, your tax details and your bank account, and update them when they change. Details are set out in the Payout and Tax Policy.

You are responsible for what you promise subscribers in your offer description and in the Zone, e.g. the number of posts, answers to questions or a behind-the-scenes look at your training. The offer description must be accurate and must not mislead. If someone brings a claim against us because of your content or promises, you are liable for the damage you caused us as a result, under the general rules of law.

Zone content is subject to the community rules in the Terms of Service — you must not publish content in the Zone that is illegal or breaches those rules. You label advertising in your Zone as advertising. You must not create payments artificially, e.g. by subscribing to your own Zone from other accounts.

You must not use a Zone to raise funds for other people or organisations, as described in the Terms of Service. A Zone that is a fundraiser will be closed and subscribers’ payments will be refunded. You will receive no payouts from it, and you must return any funds already paid out.

Data in the Zone

In the App you see your subscribers (their AthSpace profiles and subscription status), payment history broken down into VAT and fees, settlements, payouts and activity in your Zone’s community. We do not give you subscribers’ email addresses, phone numbers or payment details.

You use subscribers’ data only to run your Zone. We process Zone data, including content, payments and subscribers’ data, for the purposes and under the rules described in the Privacy Policy.

You can obtain a copy of the data on your settlements and payouts even after the agreement ends by writing to [email protected].

Suspension of the Zone and payouts

We may suspend your Zone — in whole or in part, e.g. by stopping sales of new subscriptions — or withhold payouts if: you breach the Terms of Service, this agreement or the law; Stripe or a store requires it; required data is missing or Stripe verification has not been completed; we have a reasonable suspicion of payment fraud; or a court ruling or a decision of an authority requires it.

We inform you of a suspension by email no later than when it takes effect, with a statement of reasons: the reason, the circumstances and what you need to do for the suspension to end. We give no statement of reasons only where the law prohibits it.

You can clarify the circumstances and file a complaint as described in the section “Complaints”. When the reason ceases or it turns out that the suspension was unjustified, we promptly restore the Zone and payouts and pay out the withheld amounts in accordance with the Payout and Tax Policy.

Termination

You can end the agreement at any time by closing your Zone in the App. Sales of new subscriptions stop immediately, and subscribers keep access until the end of their paid period. Subscriptions paid through Stripe stop renewing, and we ask store subscribers to cancel their subscription in the store.

We may terminate the agreement with 30 days’ notice only for important reasons: AthSpace closing down, or a change in the law or a decision of an authority that prevents the Zone from being run any further. Termination for failure to accept a new version of the agreement is described in the section “Changes to the agreement”.

We may terminate the agreement without notice in the event of a serious or repeated breach of the Terms of Service, this agreement or the law, e.g. when the Zone is a fundraiser, when you provide false information or when you commit payment fraud.

We inform you of termination by email, with a statement of reasons. You can file a complaint as described in the section “Complaints”.

After the agreement ends, subscribers keep access to the Zone content until the end of their paid periods, and we pay out the balance due to you in accordance with the Payout and Tax Policy, except for a Zone that was a fundraiser. Your content remains yours.

Changes to the agreement

We may change this agreement and the Payout and Tax Policy for important reasons: changes in the law, adding or withdrawing features, changes to payments (including the rules of the stores and Stripe), security reasons or decisions of authorities.

We announce a new version by email and in the App at least 15 days before it takes effect, and with shorter notice only when required by law or for security. The current version and previous versions are available at athspace.com. Changes do not apply retroactively — periods before a new version takes effect are settled under the version in force at the time.

You accept a new version in the App. If you do not want to accept it, you can end the agreement before the day it takes effect by closing your Zone.

If you do not accept a new version by the day it takes effect, we terminate the agreement with 30 days’ notice counted from that day and inform you of this by email. During the notice period the previous version of the agreement applies to you, the Zone does not accept new subscribers, we cancel subscriptions paid through Stripe with effect from the end of their paid period, and we ask store subscribers to cancel their subscription in the store. When the notice period ends, the Zone ends and we pay out the balance due.

Acceptance given after notice of termination does not withdraw it. Once the Zone is closed, you can start selling again by accepting the current version of the agreement.

Account deletion

Deleting your account ends the agreement. Subscribers keep access to the Zone content until the end of their paid period, for up to 30 days, after which we delete the Zone content. This also applies to the Zone of a team you own — a team with a paid Zone is deleted together with your account.

We pay out the balance due to your payout account even after your account is deleted. We keep settlement and tax data and proof of acceptance of the agreement for the period stated in the Privacy Policy.

Complaints

Send complaints about the Zone, settlements, payouts and our decisions to suspend or end the agreement to [email protected]. Describe the matter and give your account email address and the Zone’s profile.

We handle complaints without undue delay, within 14 days at the latest, and reply by email with a statement of reasons. Filing a complaint does not limit your right to pursue claims in court.

Governing law and final provisions

This agreement is governed by Polish law. If you are a consumer from another European Union country, you keep the protection given to you by the mandatory laws of your country. Disputes are resolved by the court with jurisdiction under general rules.

If you conclude the agreement as a consumer or as a business to which we apply the consumer protection rules, nothing in it limits the rights given to you by mandatory law. Our liability is set out in the Terms of Service.

This agreement is available in Polish and English. If the versions differ, the Polish version prevails.
