Terms of Service
The rules for using AthSpace: accounts, profiles, publishing, following, the PRO plan and the Subs Zone.
In force from 29 September 2026
A new version of this document applies from 15 October 2026.
We added a posting block (for 7 or 30 days or permanently) to the possible moderation decisions. We removed the mention of AI assistance from the description of the decision email.
Read the new versionWho runs AthSpace
AthSpace is a mobile app and the athspace.com website for athletes and their fans. It is run by Michał Jankowski, an entrepreneur trading as Michał Jankowski Miart, ul. Wesoła 11, 82-500 Kwidzyn, Poland, tax ID (NIP) 5811841807, entered in the Polish Central Register and Information on Economic Activity (CEIDG) (“we”, “us”).
Contact: [email protected]. This address is also the single point of contact for users and for authorities of European Union member states, the European Commission and the European Board for Digital Services under the Digital Services Act (DSA). We write in Polish and English.
These terms set out the rules for using AthSpace and are the terms of service required by the Polish Act on Providing Services by Electronic Means. We make them available free of charge on this page and in the app; you can save and print them at any time. They are also available in Polish; if the versions differ, the Polish version prevails.

What we offer
Free: the account and profiles, the daily feed with posts, photos, events and activities, workout import from connected devices, race results, trophies and records, reports, goals, following, reactions and comments, teams and groups, and the Chiron assistant in its basic scope.
Paid: the PRO plan (Subs Zone, a public page with the Creator, extended Chiron options) and subscriptions to other creators’ Subs Zones.
Some features are rolled out gradually or to selected people, and during the closed beta some of them may be unavailable. The scope of features changes as AthSpace develops; we announce changes to paid services in advance.
Technical requirements
To use the App you need a phone running iOS or Android in a version supported by the current App release (the App Store and Google Play show the required version), internet access, an email address or a Google or Apple account, and a phone number that can receive text messages. The Website works in current versions of popular browsers.
Using the internet carries typical risks, such as malware or attempts to steal passwords. Protect your device and sign-in details. We never ask for your password or text message code in a message.
Account
You enter into the agreement to use AthSpace with us by creating an account. The agreement is free of charge and concluded for an indefinite period. During the closed beta you can create an account only with an invitation; you can join the waitlist on the Website or in the App.
When creating an account you confirm your email address with a code from a message (when signing in with Google or Apple, the provider confirms the address) and your phone number with a code sent by text message. A phone number can belong to one account only.
Your account is personal. You provide true information, do not share your account with others and keep your password confidential. If you suspect someone has accessed your account, change your password, sign out other sessions in settings and write to us.
You can create an account if you are at least 13 years old. If you are under 18, you use AthSpace with the consent of a parent or legal guardian, and if you are under 16, a parent or guardian gives or approves consent to the processing of your data, including health data from workouts. The Chiron assistant is available from age 16, and only adults can run a Subs Zone with payouts.
Profiles, teams and groups
An account has at most one personal profile: athlete or observer. An observer can change their profile into an athlete profile once; the change cannot be reversed.
You can create teams and groups if the feature is available to you. A team profile is always public. A group is available only to its members and can be visible in search or hidden.
The owner of a team or group is responsible for the profile’s content and for choosing who gets admin or moderator roles. Admins and moderators act on behalf of the profile within their role. The owner can transfer ownership to another person.
A profile’s name and address (e.g. athspace.com/john-smith) must not mislead about identity or infringe the rights of others, including trademarks. Some addresses are reserved. We may change an address that contains a public figure’s name if the profile does not belong to that person.
Rules of use and community rules
You use AthSpace in accordance with the law, good practice and these terms. You respect other users, also in comments, questions and messages.
You must not provide unlawful content or content that breaks the community rules, in particular (you choose the same categories when reporting content): harassment or insults (attacks, intimidation, defamation, disclosing other people’s data); hate speech (insulting people because of origin, religion, gender, orientation or other characteristics); nudity and sexual content, including any sexualisation of minors; violence and threats (inciting violence, graphic scenes); spam and fraud (mass or unsolicited advertising, advertising not marked as such, scams, suspicious links, impersonating other people or organisations); illegal content (e.g. trading in doping or prohibited substances, fake fundraisers, infringing copyright, image rights or personal rights).
You also must not: disrupt AthSpace, bypass security measures and limits, collect data by automated means without our consent, create accounts automatically, upload files containing malware, or claim other people’s sports results as your own.
Your content
The Content you publish remains yours. You are responsible for it and confirm that you hold the rights to it, including the consent of people shown in photos and videos.
By publishing Content you grant us a non-exclusive, royalty-free, worldwide licence to record and store, reproduce, adapt to format (e.g. resizing photos, drawing a route map) and make it available to the public in AthSpace, including on the Website and public pages, so that people can access it from a place and at a time of their choosing — within the visibility settings you choose.
The licence ends when you delete the Content or your account. The exceptions are contributions to other people’s conversations, which stay without your data after account deletion (section “Account deletion and termination”), and copies of reported Content, which we keep for the period stated in the Privacy Policy. Content disappears from backups within 30 days.
You decide who sees Content when you publish it and in privacy settings: only you, Zone subscribers, followers or everyone. Public Content is visible to all users, and if you show it on your public page, also to people without an account.
You can share your Content outside AthSpace, e.g. as an image on Instagram. Other services are governed by their own terms.
Race results
We collect results from publicly available race results websites and show them in AthSpace, including in event rankings. Results may contain errors from the source or errors introduced when processing them and are not an official statement by the organiser.
We suggest results that may belong to you. To compare them we use, among other things, your name, date of birth and town, also with the help of an AI model. A result appears on your profile only after you confirm it. Confirm only your own results; the results of one person in the results lists can be confirmed by one account only.
If someone has confirmed your results or a result is wrong, write to us. We detach results confirmed by someone who is not the person in the results list from their profile.
Devices and integrations
You can connect AthSpace to your account with a device maker (including Garmin, COROS, Polar, Wahoo, Zepp and Hammerhead). The connection is handled by our technical intermediary, and you consent to the data transfer on the maker’s website. We import activities, including GPS routes, heart rate, power and cadence, also from the 30 days before connecting.
You can disconnect at any time in the App. We then stop importing, and imported workouts stay until you delete them.
You use device makers’ services on their terms. We are not responsible for interruptions in data transfer on their side.
Heart rate and calculations
From heart rate recorded by a device or entered when adding an activity manually, and from your date of birth, we calculate, among other things, heart rate zones, estimated maximum heart rate, training load, form and fatigue, trends, period comparisons and report summaries. For this purpose we combine heart rate data with other activity data and transform it (e.g. average, round and total it over periods). We keep the original workout file from the device unchanged.
By accepting these terms, you give your explicit consent to this processing of heart rate data, which may be health data, in order to show you statistics, trends and reports in AthSpace. You can withdraw consent at any time by writing to [email protected] or by disconnecting the device and deleting activities with heart rate; without heart rate we cannot show the indicators calculated from it. Details are in the Privacy Policy.
You can hide your heart rate from others at any time: for new activities in activity settings, and for existing ones when editing the activity. Heart rate zones, training load and form in reports are visible only to you by default.
Calculations are informative estimates. They are not a diagnosis or medical advice.
The Chiron assistant
Chiron is an AI assistant for athlete profiles, available from age 16 after you consent in the App. It answers based on your workouts, goals, what you write to it and the facts it has remembered. Answers are generated by an external language model.
Chiron is not a coach, doctor or dietitian. Its answers are not medical advice or a training plan and may contain errors. If you have pain, an injury, an illness or doubts about your health, consult a doctor or physiotherapist.
A free account has a daily message limit, and PRO has a higher limit and extra options, including choosing a character and message frequency. You can turn Chiron off and clear its memory and conversation in the App.
The PRO plan
PRO is a monthly or yearly subscription for an account. It gives you the Subs Zone, a public page with the Creator and extended Chiron options. Teams and groups use the PRO of the account that owns them.
You buy PRO in the App through the App Store or Google Play. The store is the seller and processes the payment, and the purchase is also subject to its terms. You see the price including taxes, the billing period and any free trial in the App before you buy.
If a free trial is available in the store (e.g. the first month free), it applies on the store’s terms. After the trial the subscription becomes paid unless you cancel it before the trial ends, within the time the store specifies.
The subscription renews automatically for the next period. You can cancel it at any time in the subscription settings of the store where you bought it; PRO then stays active until the end of the paid period. Deleting your AthSpace account does not cancel the store subscription.
The subscription belongs to the store account (Apple ID or Google account) and gives PRO to one AthSpace account. To have PRO on another AthSpace account, cancel it in the store and buy PRO on that account after the paid period ends. Refunds are handled by the store under its own rules.
When PRO expires, your public page stops being visible; when you renew PRO, it returns in its last published version. We announce PRO price changes in advance, and the store asks for your consent to the new price or informs you before renewal, according to its rules.
Subs Zone for subscribers
A Subs Zone is a creator’s space: posts for subscribers only, questions to the creator with a limit per billing period, threads and a community. A Zone can be paid or free; joining a free Zone may require the creator’s approval or an invitation.
You subscribe to a paid Zone in the App through the App Store or Google Play on the same terms as PRO: the store is the seller, the subscription renews monthly, you cancel it in the store, and refunds are handled by the store. You see the price before you buy. In the App you can subscribe to up to 20 paid Zones at the same time.
You can also pay for a paid Zone by card through Stripe in a browser. In that case we are the seller and Stripe processes the payment. You see the price in euros or US dollars, with VAT charged according to your country, before you pay. The subscription renews monthly and we charge each month in advance. You can cancel at any time in the App or in the payment settings; access stays until the end of the paid month and no further payment is taken. You can undo the cancellation until the end of that period.
Content in a Zone is created by the creator, who is responsible for it and for what they promise subscribers. We do not guarantee that a creator will publish a certain number of posts or answer every question. Each new billing period gives you a new question limit, even if an earlier question is still waiting for an answer.
All subscribers of a Zone see its questions and answers. The creator and moderators can hide a contribution, close a thread or block a person in the Zone’s community.
If the creator closes the Zone or makes it free, you keep access until the end of the paid period. If the creator deletes their account, the Zone keeps running for 30 days, during which the creator can restore the account; after that you can access its content until the end of the paid period, for up to 30 days, after which the content is deleted — we will let you know. A subscription paid through Stripe then stops renewing.
In each of these cases, cancel the store subscription — the end of the Zone does not cancel it. You request a refund of a payment the store charged for a period without access from the App Store or Google Play.
Subs Zone for creators
A Subs Zone can be run by an athlete or team with active PRO whose profile is not private; payouts from a team’s Zone go to its owner. To receive payouts you must be an adult, pass identity verification and provide tax details and a bank account. Verification and payouts are handled by Stripe under its connected account agreement, which you accept during setup.
You choose the price from the list available in the App. Every price change needs our approval, and existing store subscribers keep their current price.
From each subscriber payment we first deduct VAT, then the store or payment provider fee (in the stores 15% to 30%, depending on the store and how long the subscription has lasted), and from the remaining amount our 15% fee, unless we agree otherwise with you. The rest is your revenue.
We settle each month after it ends and pay out the amount due through Stripe to the account you provided. A refund reduces the revenue of the period in which it occurred.
You are responsible for the taxes on your Zone revenue. We may be required to report information about your revenue to tax authorities, including under the rules on exchanging information about sellers on platforms (DAC7).
You are responsible for your Zone’s content and what you promise subscribers. We may suspend a Zone or payouts if you breach these terms or the law, or if Stripe or a store requires it. When setting up a Zone you also accept the creator agreement and payout terms shown in the App.
You must not use a Subs Zone to raise funds for other people or organisations. You must not create a profile or open a Zone in order to collect money for someone else — for example for medical treatment, aid or a charitable cause — or present a subscription as a payment for another person or organisation. You may combine sport with charitable goals and donate part or all of your Zone revenue to them, as long as the Zone remains your creator space with content for subscribers rather than a fundraiser.
A Zone that is a fundraiser will be closed and subscribers’ payments will be refunded. The creator will receive no payouts from such a Zone and must return any funds already paid out.
If you delete your account while running a Zone, for 30 days, during which you can restore the account, the Zone keeps running for existing subscribers but does not accept new ones. After that, subscribers keep access to its content until the end of the paid period, for up to 30 days, after which the content is deleted. Subscriptions paid through Stripe stop renewing, with no refunds for the current period. We will pay the balance due to your payout account even after your account is deleted.
Reporting illegal content and moderation
You can report a post, comment or event you believe is illegal or breaches these terms in the App with the “Report” button: you choose a reason and, for illegal content, explain why it is illegal. Reports are confidential — we do not tell the author who reported it, unless the law requires it — and the reported content stops being shown to you immediately.
Other content (e.g. a profile, a public page or a contribution in a Zone) and reports from people without an account can be sent to [email protected]. Such a report should include: an explanation of why the content is illegal; the exact location of the content (e.g. profile address, a screenshot and a description of where it is in the App); your name and email address (not required when reporting content related to child sexual abuse); a statement that you are reporting in good faith and that the information is accurate and complete.
We handle reports without undue delay and objectively. Reported content is first assessed by an AI model that suggests a decision, but the decision is always made by a person on the AthSpace team — we do not remove content or suspend accounts automatically. We inform the people who reported the content of our decision.
If Content or behaviour is illegal or breaches these terms, we may issue a warning, remove the Content or restrict its visibility, disable a feature, suspend the account for 7 or 30 days or permanently, or delete it. We take into account the severity and repetition of the breach. Accounts that frequently publish manifestly illegal content or submit manifestly unfounded reports are suspended for 7 or 30 days after a warning.
We inform the person affected by a restrictive decision with an in-app notification and an email giving the reasons (including that an AI model assisted the assessment), unless the law prohibits it. You can appeal a decision at [email protected] within 6 months, quoting the case number from the email. You can also go to court.
You can block another user’s account from their profile, post, comment or event. A block works both ways: you do not see each other’s profiles and content, and cannot follow, comment on, react to or send invitations to each other. Your subscriptions to each other’s paid Zones end at the end of the paid period, and until then the Zone is read-only; membership in a free Zone ends immediately. You cancel a store subscription yourself. You can remove a block in Settings; unblocking does not restore follows or subscriptions.
Complaints
If AthSpace does not work as described, send a complaint to [email protected]. Describe the problem, give your account email address and, if you can, attach a screenshot. We will reply within 14 days of receiving the complaint to the address you sent it from.
Complaints about store payments (refunds, double charges) are handled by the App Store or Google Play.
As a consumer you have statutory rights if a digital service does not conform with the contract, including the right to have it brought into conformity, to a price reduction or to withdraw from the contract, under the Polish Consumer Rights Act.
Right of withdrawal
A consumer can withdraw from a distance contract within 14 days of concluding it without giving a reason. It is enough to send a statement of withdrawal to [email protected] before the deadline; you may use the model withdrawal form in Annex 2 to the Polish Consumer Rights Act. You can also end the agreement for a free account at any time by deleting your account in the App.
For PRO and Zone subscriptions bought in the App Store or Google Play, the store is the seller, so withdrawal from such a purchase and refunds are handled by the store under its rules and the laws that apply to it.
For a Zone subscription paid through Stripe, we are the seller. After withdrawal we will refund the payment within 14 days of receiving your statement, using the same payment method; if you asked for access to the Zone before the withdrawal period ended, we reduce the refund in proportion to the time the Zone was available.
Liability
We aim for AthSpace to run without interruptions or errors, but technical breaks may occur, especially during the closed beta.
We are not liable for users’ Content or content in Zones if we did not know it was unlawful and, after receiving credible notice, promptly disabled access to it. Data, reports and Chiron’s answers are for information only; you make your own training and health decisions.
Towards consumers we are liable as provided by law. Towards businesses to which we do not apply the consumer protection rules, we are liable only for damage caused intentionally or through gross negligence.
Account deletion and termination
You can delete your account at any time in the App: Settings → Delete account. If you cannot access the App, write to [email protected] from your account email address and we will delete it for you. Once you confirm, your account is blocked and your profiles and Content disappear for others immediately. For 30 days you can restore the account — in case of a mistake or if someone who gained access to your account deleted it — by signing in to the App or with the link in the email we send straight away. After 30 days we delete the account permanently together with the remaining data, except data we keep longer as described in the Privacy Policy; this can no longer be undone.
A team or group of yours that has an admin passes to its longest-serving admin, unless the team runs a paid Subs Zone; other teams and groups are deleted together with your account.
Your contributions and reactions in other people’s conversations — comments, Sup! reactions, likes, and threads and replies in other creators’ Zones — stay so that the conversations remain understandable for the other participants, but under the label “Deleted account”, without your name, photo or a link to your profile. Event covers you created also stay, and the event continues without an author. If you want any of this removed, delete it before deleting your account or write to us later (details in the Privacy Policy).
Deleting your account does not cancel subscriptions bought in the App Store or Google Play — cancel them in the store, preferably before deleting your account. If you do not, the store will keep charging you even though you no longer have access; you request refunds of such charges from the store. Subscriptions paid outside the stores (through Stripe) stop renewing when you delete your account, and if the paid period lasts longer than 30 days, they end on the day the account is permanently deleted, with no refund for the unused part of the period, unless the law provides otherwise. If you restore your account, you can resume them in the App.
We may terminate the agreement with 30 days’ notice only for important reasons: AthSpace closing down, or a change in the law or a decision of an authority that prevents us from continuing to provide the service; and without notice in the event of a serious or repeated breach of these terms or the law. We inform you of termination by email and give the reasons.
Changes to these terms
We may change these terms for important reasons: changes in the law, adding or withdrawing features, changes to payments, security reasons or decisions of authorities. We inform you of a change by email and in the App at least 15 days before it takes effect, and with shorter notice only when required by law or for security. If you do not accept the changes, you can delete your account before they take effect.
Changes do not worsen the terms of subscription periods already paid for.
Governing law and disputes
The agreement is governed by Polish law. If you are a consumer from another European Union country, you keep the protection given to you by the mandatory laws of your country.
Disputes are resolved by the court with jurisdiction under general rules. Consumers can use out-of-court dispute resolution, e.g. help from a district or municipal consumer ombudsman. A list of bodies is available on the website of the Polish Office of Competition and Consumer Protection (uokik.gov.pl).
We also apply the consumer protection rules to a natural person who concludes an agreement directly related to their business, if the agreement is not of a professional nature for them.
The processing of personal data is described in the Privacy Policy, and the use of cookies and similar technologies in the Cookie Policy.
